When can attorney’s fees be awarded in Florida divorce?

F.S. 61.16 (1) grants the court the authority to award attorney’s fees in “any proceeding under [chapter 61].” Chapter 61 includes all proceedings for divorce, support, and time-sharing. Attorney’s fees may be awarded for other reasons related to divorce, but not mentioned in chapter 61 including partition orders, paternity cases and actions for indirect criminal contempt. See F.S. Chapter 61, “Dissolution of Marriage.”
